BUSINESS CERTIFICATES
In conformity with the provisions of Chapter 110, Section 5 of Massachusetts General Laws, as amended, you are required to have a Business Certificate if you are doing business under any name other than your own.
The Business Certificate is issued to fulfill requirements of your business activity as a notice to the public that you are about to operate a business and to notify the Commonwealth of Massachusetts for the same or similar purposes. Be advised, however, that the acquisition of the Business Certificate is the first in a series of requirements which must be met before you are legally entitled to conduct business activity. For more detailed information, you are strongly urged to confer with the Zoning & Building Official, the Special Permit Granting Authority, and other applicable jurisdictions as required by Massachusetts law; i.e., Board of Health, Conservation Commissionand/or inspectors of wiring, plumbing, sanitation and structures. It is also strongly recommended that you confer with competent legal counsel and your
insurance agent at the outset.
Business certificates shall be in effect for four (4) years from the date of issue and shall be renewed each four (4) years thereafter. A statement under oath must be filed with the Town Clerk upon discontinuing, retiring, or withdrawing from such business or partnership.
Copies of such certificates shall be available at the address at which such business is conducted and shall be fornished on request during regular business hours to any person who has purchased goods or services from such business.
Violators are subject to a fine of not more than three hundred ($300.00) dollars for each month during which such violation continues.
The business certificate only entitles the business to register with the Town of Berkley. It in no way authorizes or waives any provisions of the Town of Berkley Bylaws.
The forms must be signed by all parties either in front of a notary or in the Town Clerk's Office.
The current cost is $30.00 for a new or renewal Business Certificate.
